Contractual Terms and Conditions for the Use of the Expert Directory

1. Expert Directory

Switzerland Global Enterprise (S-GE) operates the Expert Directory, accessible at the website http://expertdirectory.s-ge.com. This has the purpose of bringing together Swiss and Liechtenstein SMEs (users) and experts. The experts are companies that have registered with S-GE as experts in export-related fields.

The present contractual terms and conditions for the use of the Expert Directory are deemed to have been accepted by the user when using the website.


2. Directions for Use

The Expert Directory is directed exclusively at users who are domiciled in Switzerland or Liechtenstein. The Expert Directory is made available to users free of charge.

The experts are not vetted or supervised by S-GE, nor does S-GE verify the details they provide. Contacting the experts and negotiating and concluding contracts with them take place at the user’s own risk. Where the mediation of an expert leads to a contract being concluded (e.g. a contract of service), then such a contract exists solely between the user and the expert.

The user agrees that the contact inquiry sent to the expert via the function "send message" may be viewed by S-GE for the purpose of preventing the delivery of unwanted messages (spam), and if necessary may only be forwarded after a certain delay or deleted, should there be an indication that it is spam. The contact inquiry shall be treated as confidential. It will be forwarded to the e-mail address provided by the expert. In doing this S-GE does not accept liability for the secure transmission of the contact inquiry or for ensuring that only the expert gains access to it.

S-GE retains all rights to the concept, layout and design of the Expert Directory. S-GE similarly retains all the name and trade mark rights to which it is entitled.

S-GE is authorised to modify the Expert Directory at any time technically or in its content, or to cease its operation entirely. S-GE does not guarantee any unrestricted availability of the service.

The use of mechanisms, software or scripts in connection with the use of the Expert Directory is prohibited. Similarly prohibited are blocking, overwriting, modification or copying of the Expert Directory, except where this is required within the framework of ordinary use. Also prohibited are all actions designed to impair the functioning of the Expert Directory, in particular those that might overload it.

3. Limitation of Liability

S-GE does not accept liability for non-performance or faulty performance (e.g. inadequate advice) by the experts that it mediates.

Nor does S-GE accept liability for the correctness, completeness or quality of the information published in the Expert Directory. Furthermore, it does not accept any responsibility for the behaviour of the experts, of the other users, or for the content of external websites that are linked to its website.


4. Final Provisions

The parties declare the data protection provisions of S-GE to be an integral part of the present contractual terms and conditions.

Should any individual clauses of these contractual terms and conditions be or become invalid, this shall not affect the validity of the remaining clauses. The invalid clause shall be replaced by one that is valid and that emulates the content and purpose of the invalid clause as closely as possible.

The legal relations between the parties shall be governed exclusively by Swiss law.

The sole place of jurisdiction for the legal relations between the parties is Zurich (Switzerland).
